Statement on the process for appointing ECN commissioners

An office statement dated 9 July 2026 argues that presidential letters to the Speaker nominated ECN commissioners rather than appointing them under Article 94B.

The office PDF reviews two State House letters to the Speaker, dated 8 June and 10 June 2026. It quotes the first as nominating Emmerentia Leonard and Julieta Diva Ferreira for approval for appointment as members, and the second as nominating Dr Gerson Sindano for approval for appointment as chairperson.

The published argument is that Article 94B says members of the Electoral Commission shall be appointed by the President with the approval of the National Assembly, and that “nominate for approval for appointment” is not the same act. The statement also asks for the sworn declarations that Gazette 8896 of 27 April 2026 required of applicants.

It records four steps: object on the floor, ask the President to withdraw the nominations and table an instrument of appointment, ask the nominees to declare party-political office under oath, and, if the Assembly proceeds, seek High Court relief. That is the office position. This page does not decide the constitutional question.

The Namibian of 10 July 2026 reported the same Thursday statement. That article also records a separate High Court application by Affirmative Repositioning, which is not summarised here.
